Why refer an FCRA case

These cases reward specialists

The FCRA is a fee-shifting statute litigated against a handful of repeat defendants. Knowing their playbook is most of the battle - and no plaintiff's firm has spent more time inside it.

FCRA cases are worth more than they look

Statutory damages, punitive exposure, and fee-shifting under 15 U.S.C. §§ 1681n–1681o change the settlement calculus. A claim that might resolve for nominal value in general practice can be worth many multiples of that when litigated by attorneys the bureaus already know will try the case. Better for the client - and better for the referring attorney.

We have already built the record

Thousands of federal FCRA cases against Equifax, Experian, TransUnion, and their furnishers. We know their reinvestigation systems, their e-OSCAR shortcuts, their deposition witnesses, and their settlement patterns - because we have taken them to verdict.

Pleadings, discovery, and expertise - shared

Our philosophy is to give the material away. Referring and co-counsel attorneys get access to our pleadings, discovery templates, expert relationships, and decades of institutional knowledge about how these defendants litigate.

The lawyers other lawyers learn the FCRA from

Our attorneys are lead CLE speakers on the Fair Credit Reporting Act, contributing authors to the leading FCRA treatise, and have trained consumer rights lawyers at NACA, NCLC, ABA, and state bar programs nationwide.

The process

How referral & co-counsel works

No committees, no intake maze. You talk to the lawyers who will work the case.

01

Send us the case

Call or use the contact form. Share the credit reports, the dispute history, and what your client has lost - a short summary is enough to start.

02

We evaluate together

We review the file for FCRA liability - willful and negligent noncompliance, reinvestigation failures, furnisher violations - and give you a candid read on value and venue.

03

Co-counsel on your terms

Full referral or active co-counsel - your choice. Fee-division arrangements comply with the applicable rules of professional conduct and are documented with client consent.

What we look for

Cases we co-counsel

One threshold matters more than anything else: under the FCRA, no claim against a bureau exists until the consumer has disputed. If your client has disputed - or you can help them dispute properly - these fact patterns are worth a call:

  • Disputes returned "verified" without a real investigation
  • Mixed files - another consumer's data on your client's report
  • Identity theft accounts the bureaus refuse to block under § 605B
  • Deleted items that reappear without the required certification
  • Deceased indicators, re-aged debts, and obsolete items past the 7-year limit
  • Furnishers who ignore § 1681s-2(b) investigation duties
  • Background check errors that cost your client a job or housing
